GUEST RENTAL AGREEMENT

This Guest Rental Agreement ("Agreement") is entered into between Elite Lake Rentals LLC ("Elite," "Company," "we," or "us"), acting for itself and for the owner of the Property ("Owner"), and the person who is the responsible renter of the Property (collectively "Renter" or "you"). This Agreement is a vacation rental agreement for transient occupancy of the Property and does not create a residential lease, tenancy, or landlord-tenant relationship under Wisconsin law or the law of any other jurisdiction.
By booking your rental of the Property with Elite, you acknowledge that you have read and understand, and agree to be bound by, all terms, conditions, and policies in this Agreement, including any Property-Specific Terms (collectively, the "Terms").
ARTICLE I: PROPERTY USE AND OCCUPANCY
Section 1.1 Maximum Occupancy
The Property shall not be used at any time by more than the number of adults and children listed in your confirmed reservation. All occupants must be registered guests. Exceeding maximum occupancy at any time, including with day visitors, is prohibited and may result in immediate termination of the rental agreement without refund.
Visitor Restrictions:
• Day visitors are permitted but total people on property (guests + visitors) may not exceed maximum occupancy plus 4 additional people
• Any visitors that would cause the property to exceed maximum occupancy must be pre-approved by Elite
• No visitors are allowed at the property past 10:00 PM if their presence would exceed maximum occupancy
• Overnight guests that would exceed maximum occupancy are strictly prohibited
• All visitors must comply with property rules and quiet hours
Section 1.2 Minimum Age Requirements
The "Minimum Age" to rent the Property is twenty-five (25) years of age, or the age specified in any Property-Specific Terms. The primary Renter who makes the reservation must be at least 25 years of age and must be present at the Property for the entire duration of the rental.
Age Requirements: Primary Renter must be 25+ and present for entire stay. All guests must be 18+ unless they are minor children supervised by an adult 25+. There must be at least one guest 25+ for every two guests under 25. Elite may verify ages at check-in or any time during stay. All guests must be registered on reservation and count toward occupancy limits.
Children and Young Adult Guests: Minor children (under 18) traveling with their parents/legal guardians are welcome and count toward maximum occupancy. The primary Renter (25+) is responsible for supervising all guests under 25.
Consequences for Age Misrepresentation: Providing false information about age during booking or check-in constitutes fraud and breach of this Agreement. If it is discovered that the primary Renter is under 25, any guest is under 18 (except minor children with proper supervision), or the 25+/under-25 supervision ratio is violated, Elite may immediately cancel the reservation and remove all occupants from the Property without refund. All rental payments, fees, and deposits are forfeited if the reservation is cancelled due to age misrepresentation.
Section 1.3 Responsible Renter
As the Renter, you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over the Minimum Age, or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, "Occupants") present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms.
Section 1.4 No Permanent Residence
You agree that your use of the Property is on a temporary and transient basis only; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than at the Property.
Section 1.5 Unregistered Guests and Visitor Policies
Only registered guests may stay overnight at the Property. Unauthorized visitors or gatherings are strictly prohibited. All overnight guests must be registered on the reservation at time of booking or added with prior approval. Day visitors are permitted but must leave by 10:00 p.m. unless specifically approved. The primary Renter is responsible for ensuring all guests, visitors, and friends comply with all property rules. Unauthorized overnight guests will result in immediate termination of the rental agreement without refund.
Section 1.6 Corporate and Third-Party Bookings
If the Renter is a business entity, organization, or any party other than the individual(s) who will occupy the Property, the Renter is fully responsible for the conduct of all Occupants placed at the Property, including compliance with all Terms. The Renter's obligations under this Agreement, including Sections 7.2 (Damage and Liability), 12.3 (Legal Fees), and 14.4 (Indemnification), apply with full force regardless of whether the Renter personally occupies the Property. The Renter may not assign or delegate its obligations under this Agreement to the Occupants or any third party without Elite's prior written consent.
Section 1.7 No Subletting or Assignment
Renter may not sublet, sublicense, or assign this Agreement or any rights under it to any third party without Elite's prior written consent. Occupancy is limited to the registered guests identified in the reservation.
Section 1.8 Extensions
Any extension of the original reservation period requires Elite's prior written approval and payment in advance. All terms of this Agreement apply to any extension period. Extended stays do not create a residential tenancy, landlord-tenant relationship, or any rights beyond those expressly stated in this Agreement, regardless of the total duration of occupancy.
ARTICLE II: CONDUCT AND BEHAVIOR POLICIES
Section 2.1 Good Neighbor Policy
Because the Property is a privately owned home, all Occupants must comply with this good neighbor policy. Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to Elite from police, neighbors, or neighborhood or homeowner associations.
Quiet Hours and Noise Policy: Noise audible outside the Property is prohibited between 10:00 p.m. and 8:00 a.m. You and other Occupants agree to abide by all applicable parking restrictions and limitations.
Noise Monitoring: Elite properties are proactively monitored for compliance with this noise policy. Decibel sensors notify Elite of sounds in the property that exceed 75 decibels (dB). The noise sensors are 100% privacy compliant and required on this property. You hereby consent to the use of sound level monitoring. If Elite receives a noise complaint from a neighbor and/or receives a notification that the noise level in the property has exceeded 75dB, Elite will contact you and issue a first warning to reduce the noise level. If, after the first warning, Elite subsequently receives an additional noise complaint and/or notification that the noise level in the property has exceeded 75dB, Elite reserves the right, in its sole discretion, to charge you a penalty of $500 and/or remove you and all occupants from the property without a refund.
Section 2.2 Prohibited Activities
The following activities are strictly prohibited:
a) Smoking and Vaping: No smoking or vaping is permitted inside any Property or on any covered outdoor areas, wooden decks, or wooden surfaces. Smoking is only permitted in the driveway area or by fire pits (when active), and all cigarette butts must be properly disposed of. Violation will result in a damage fee of $1,000.
b) Criminal Activity: Including but not limited to underage drinking, marijuana use, illegal drugs, drug paraphernalia, illegal downloads, and any violation of federal, state, or local laws — results in immediate removal from the Property without refund. This prohibition extends to use of the Property's internet service for criminal activity. Elite may cooperate with any investigation of alleged criminal activity that occurred at the Property during your stay.
c) Commercial Use: Commercial photography, filming, or events are prohibited without express written permission from Elite. If approved, additional conditions and fees may apply.
d) Confetti and Glitter: Use or bringing of confetti and/or glitter onto any part of the property is prohibited. If any of these items are found on the property, it will result in a damage fee of $1,000.
e) Indoor Candles and Open Flames: For safety reasons, the use of candles or any item with an open flame is strictly prohibited inside the Property. This includes, but is not limited to, decorative candles, scented candles, incense, or ceremonial flames. Violation of this policy may result in immediate removal from the Property without refund and an additional cleaning or damage fee of up to $1,000.
f) Safety Device Tampering: Tampering with or disabling smoke detectors, CO detectors, cameras, or noise monitors is prohibited. A $500 fee may be assessed for violations.
ARTICLE III: ANIMALS AND PETS
Section 3.1 Pet Policy
No animals or pets of any kind are permitted at the Property except if: (1) the home is specifically listed as dog friendly, or (2) they are recognized as bona fide service animals that we are required by law to allow under the federal Americans with Disabilities Act (ADA). Emotional support animals are not permitted. You agree that a prohibition on animals is not a guarantee that an animal has not been inside the Property or that the Property is free of animal or pet allergens. Violation of the pet policy will result in a charge of up to $1,000 and removal from the property.
ARTICLE IV: STRUCTURES, VEHICLES, AND EQUIPMENT
Section 4.1 Unauthorized Structures
No tents or other structures may be erected on the property without express written permission from Elite.
Section 4.2 Grills and Fire Equipment
Charcoal grills and outdoor heaters are prohibited. Only propane grills provided by Elite may be used.
Propane Grill Safety (Where Provided): Adult supervision required at all times when grill is in use. Check propane connections before use and ensure grill is on stable, level surface away from structures, overhangs, and flammable materials. Never use grill indoors or in enclosed areas. Turn off propane tank when finished and allow grill to cool completely. Clean grill after use and report any gas leaks, damaged parts, or malfunctions immediately. Guests liable for all damages caused by improper grill use.
Fire Pit Safety (Where Provided): Adult supervision required at all times — never leave fires unattended. Use only seasoned firewood or manufactured logs. DO NOT BURN: trash, plastic, treated lumber, cardboard, paper, leaves. Fires must be completely extinguished with water — "if it's too hot to touch, it's too hot to leave." No fire pit use during windy conditions or burn bans. Check local fire restrictions before use. Guests liable for all fire-related damages including structural repairs, landscaping, smoke damage, and emergency response costs.
Section 4.3 Parking Restrictions
Parking in garages is not permitted unless specifically stated in the property-specific arrival information. Each property has a designated number of off-street parking spaces as specified in your reservation. Elite is not responsible for guests who exceed the vehicle maximum for off-street parking — additional vehicles must find parking elsewhere at guest's own risk of being towed or ticketed. Guests must comply with all local parking regulations and restrictions.
Section 4.4 Trailers, Boats, and Motor Vehicles
The storing or parking of trailers, boats, or any motorized vehicles/RVs are not permitted unless you have written permission from Elite Lake Rentals.
Section 4.5 Furniture and Electronics
Moving furniture, unmounting TVs, or unplugging electronics is not allowed. A fee of up to $1,000 will be charged to card on file if furniture needs to be moved back to where it was originally or for any reassembly or repair.
Section 4.6 Septic System Care and Restrictions
Most Elite properties use septic systems requiring special care. Violations can cause expensive system failures and property damage.
DO NOT FLUSH: Feminine products, diapers, any wipes (including "flushable"), cigarette butts, dental floss, cotton products, medications, or excessive toilet paper.
DO NOT PUT DOWN DRAINS: Grease, fats, oils, melted butter, food scraps, coffee grounds, harsh chemicals, paint, large amounts of hair, shrimp tails, crab legs, pasta, rice, potatoes, corn husks, banana peels, celery, onions, asparagus, eggshells, bones, or any food waste.
USAGE LIMITS: Maximum 3 laundry loads per day (spaced out). Take reasonable-length showers. Report slow drains, backups, or odors immediately.
VIOLATIONS: Guests liable for all septic costs due to negligence/rule violations, including pump-outs ($300-$800), repairs, system replacement (up to $30,000+), property damage, and lost rental income.
ARTICLE V: SAFETY AND SECURITY
Section 5.1 Security Camera Disclosure
Some properties may have exterior-facing security cameras for safety purposes. No interior cameras are present at any Elite property. Security cameras, where present, may be owned and operated by the property Owner. Camera footage retention is subject to the camera owner's subscription and settings. By staying at the Property, you consent to exterior video recording for security purposes.
Section 5.2 Property Security
To prevent theft or damage, you agree to close and lock doors and windows when not present at the Property and upon check-out.
Section 5.3 Children's Safety
Guests are responsible for supervising children at all times, particularly around amenities such as pools, docks, bunk beds, water features, fire pits, and recreational equipment.
ARTICLE VI: AMENITIES AND FACILITIES
Section 6.1 Use of Amenities at Own Risk
Use of all amenities is at your own risk. Elite is not responsible for injuries or accidents related to amenity use.
Water Features and Activities: All pool, hot tub, lake, and natural water access is entirely at your own risk. No lifeguard services are provided. Children must be actively supervised by an adult at all times near water features. You assume all risks associated with water activities including drowning, slip and fall accidents, hypothermia, cuts from rocks or debris, encounters with wildlife, waterborne bacteria or parasites, and equipment malfunction. Personal flotation devices are strongly recommended. Pool and hot tub covers must be properly secured after use. Maximum occupancy limits for hot tubs must be observed. No glass containers are permitted in pool or hot tub areas.
Recreational Courts and Sports Facilities (Where Provided): All recreational courts and sports facilities are used entirely at your own risk. Court surfaces may be slippery when wet — use is prohibited during and immediately after rain. Players must wear appropriate athletic footwear with non-marking soles. You are responsible for inspecting courts for hazards before use. Children must be supervised by adults. You assume all risks of sports-related injuries and are responsible for any damage beyond normal wear.
Golf Carts (Where Provided): Golf carts are used entirely at your own risk. Prior to operating any golf cart, each driver must sign a separate golf cart waiver, provide a photo of a valid driver's license, provide proof of auto insurance, and provide a valid credit card to be kept on file for the duration of the stay. For reservations made through third-party booking channels where a credit card is not automatically provided to Elite, Renter must provide one directly to Elite before golf cart use will be permitted. Only licensed and insured drivers age 21 and older may operate golf carts. Golf cart operators must comply with all local traffic laws and posted property rules. Maximum occupancy and weight limits must be observed. Children must be seated and supervised by an adult. Use under the influence of alcohol or drugs is strictly prohibited. You assume all risks including collisions, tip-overs, and mechanical failures and are liable for all damages.
Provided Water Equipment and Flotation Devices: Any water equipment provided (paddle boards, kayaks, canoes, floating mats, pool floats, etc.) is used entirely at your own risk. Elite makes no warranties regarding the condition, safety, or suitability of any provided equipment. You are responsible for inspecting all equipment before use. Children using any water equipment must be actively supervised by an adult at all times. You are liable for any damage to provided equipment beyond normal wear and tear.
Section 6.2 Amenity Availability
The Property is provided as-is, and Elite is not responsible for the inoperability or unavailability of any amenities. Amenity availability cannot be guaranteed, and no refunds will be issued for temporary outages or maintenance issues.
Section 6.3 Maintenance Issues and Reporting Requirements
You agree to contact Elite immediately upon noticing any maintenance or housekeeping problem, or any potentially hazardous condition. Issues present upon arrival must be reported by 10:00 AM the day after arrival. Issues discovered during your stay must be reported within 1 hour of discovery. Elite will respond to reported issues within a reasonable timeframe during business hours. Guests must allow Elite reasonable access to the Property for inspections, repairs, and maintenance, and must allow vendor and contractor entry to remedy reported issues. Guests must provide Elite reasonable opportunity and timeframe to remedy reported problems. Elite does not offer refunds for maintenance issues, amenity outages, or issues that could have been prevented by following property rules, result from guest misuse, are cosmetic in nature, or if not allowed to remedy by guest.
Section 6.4 Mid-Stay Access
Elite may coordinate access for cleanings or essential maintenance with appropriate notice to guests. Elite may enter the Property at reasonable times with reasonable notice to inspect, maintain, or repair the Property, and to address any situation that Elite reasonably deems an emergency.
ARTICLE VII: FINANCIAL TERMS
Section 7.1 Payment Terms and Fraud Prevention
If paying by credit card, you represent that you are the account holder or authorized user. Elite may request alternative payment forms if fraud is suspected and may share information with law enforcement if necessary.
Section 7.2 Damage and Liability
Renter is liable for any and all damage to the property and agrees to accept charges to the card on file should damage occur during occupancy. You authorize Elite to bill your credit card for: any damage or loss occurring at the Property during your stay; violation fees as specified in this Agreement; additional cleaning fees up to $1,000 for excessive cleaning beyond standard turnover; relocation costs if future reservations must be moved due to intentional damage; any fines issued by authorities for violations during your stay; fire-related damages including structural repairs, landscaping restoration, furniture replacement, smoke damage remediation, and fire department response fees; emergency response costs associated with emergency services called due to your actions or negligence; and septic system costs including pump-outs, repairs, replacements, and related property damage caused by misuse or violations.
Renter is responsible for intentional damage and any unreported damage, whether accidental or otherwise, and authorizes Elite to bill the credit card on file for all repairs and replacements needed. If the credit card on file is unavailable, declined, or insufficient, Renter agrees to remit payment promptly upon demand through any method accepted by Elite, including but not limited to ACH, wire transfer, or electronic payment. Elite reserves the right to pursue collection through all available legal remedies for any unpaid balance. All damage must be reported to Elite prior to departing the property. Failure to report damage prior to departure does not relieve Renter of liability under this Section but may affect the availability of coverage under the Limited Damage Waiver.
Section 7.3 Additional Fees
• Late Departure Fee: Up to one night's rental if you fail to vacate by check-out time
• Excessive Cleaning Fee: Up to $1,000 for cleaning beyond standard turnover requirements
• Biohazard Cleaning Fee: Renter will be charged the full cost of professional cleaning, sanitization, and replacement of any items soiled by bodily fluids including but not limited to vomit, blood, urine, or feces. This includes mattresses, linens, towels, upholstery, carpeting, and any other affected property contents. If professional biohazard remediation is required, Renter is responsible for the full cost. This fee is not subject to the $1,000 excessive cleaning cap.
ARTICLE VIII: CANCELLATION AND REFUND POLICIES
Section 8.1 Cancellation Policy
Rental payments are fully refundable (less 3.5% processing fee and Admin fee) for cancellations received 60 or more days before the first night of your reservation. No refunds will be granted for cancellations less than 60 days before arrival, no-shows, early departures, or cancelled stay extensions.
Section 8.2 Travel Insurance
Elite strongly recommends purchasing comprehensive travel insurance to protect against financial loss if you must cancel your reservation for a covered reason. Trip insurance may be available through Elite at the time of booking. Details and pricing will be provided during the reservation process.
Section 8.3 Service Interruptions and Weather
Elite shall not be liable for failure to make the property available due to circumstances beyond its control, including adverse weather, natural disasters, mechanical failures, evacuation orders, or utility outages. No refunds will be provided for utility service interruptions, internet failures, cable/WiFi disruptions beyond Elite's control, or weather-related activity limitations.
Section 8.4 Winter Services
Elite provides snow removal services during winter months when accumulation reaches 2 inches or more. Snow removal may take up to 24 hours after a snow event for driveways to be plowed and sidewalks to be shoveled. No refunds will be provided for delays in snow removal due to weather conditions or safety concerns.
ARTICLE IX: CHECK-IN AND CHECK-OUT
Section 9.1 Check-In and Check-Out Times
Check-in begins at 4:00 PM and check-out is at 10:00 AM. Elite will message guests if the property is ready early and activate their unique door code for early entry at that time.
Section 9.2 Late Check-Out
Late check-out may be available by request for a fee. Since Elite does not hold dates without payment, late check-out cannot be guaranteed and requests will not be approved until the evening before your departure date. Failure to vacate by the designated checkout time (or approved late checkout time) authorizes Elite to charge a late departure fee of up to one full night's rental for each day or partial day of unauthorized occupancy, and to remove occupants and personal property with or without law enforcement assistance. Unauthorized occupancy beyond checkout does not create any tenancy or right to remain at the Property.
Section 9.3 Checkout Requirements
Renter must complete the following checkout procedures:
• Place all wet towels in the tub/shower
• Load and start the dishwasher, or if the property does not have a dishwasher, ensure all dishes and utensils are rinsed and stacked in the sink
• Take all garbage out and place in designated garbage cans
• Clean up any spills, stains, or messes caused during your stay
• Lock all doors and windows
• Turn off all lights
• Secure the Property
Failure to follow checkout procedures may result in additional cleaning fees.
Section 9.4 Lost and Found
Elite Lake Rentals is not responsible for items left behind by Renter or Occupants. It is the Renter's sole responsibility to ensure all personal belongings are removed from the Property prior to checkout. If Renter believes items were left behind, Renter may contact Elite by phone or email to request a search. Elite will make reasonable efforts to locate requested items but cannot guarantee items will be found, and Elite is not liable for any items that are lost, damaged, discarded, or otherwise not recovered after departure. If items are found and Renter requests shipping, Renter is responsible for all shipping costs. Items not claimed within 14 days of checkout may be disposed of at Elite's discretion.
Section 9.5 Keyless Entry Systems
All Elite Lake Rentals properties feature keyless entry systems. If you experience access issues, contact Elite immediately for remote assistance or new access codes. Elite is responsible for maintaining keyless entry system functionality, including battery replacement.
ARTICLE X: GUEST VERIFICATION AND DAMAGE WAIVER
Section 10.1 Guest Verification
Renter gives permission to Elite's designated guest verification provider to verify identity and check criminal databases to confirm the reservation. Complete terms regarding guest verification are available upon request.
Section 10.2 Limited Damage Waiver
The reservation includes a Limited Damage Waiver that provides coverage for accidental damage to property contents, real property, and bodily injury during the rental period, subject to the terms, conditions, coverage limits, and exclusions of Elite's designated coverage provider. Coverage details are available upon request. All damage must be reported to Elite prior to departing the property for claims to be approved. Renter is responsible for intentional damage and any unreported damage, whether accidental or otherwise, and authorizes Elite to bill the credit card on file for all repairs and replacements needed. If the credit card on file is unavailable, declined, or insufficient, Renter agrees to remit payment promptly upon demand through any method accepted by Elite, including but not limited to ACH, wire transfer, or electronic payment. Elite reserves the right to pursue collection through all available legal remedies for any unpaid balance. Failure to report damage prior to departure does not relieve Renter of liability under Section 7.2 but may affect the availability of coverage under the Limited Damage Waiver.
ARTICLE XI: EMERGENCY PROCEDURES
Section 11.1 Emergency Response
Elite provides a 24/7 guest service phone number for emergencies. Emergency issues (HVAC failure, plumbing problems, fire, injury, alarms) will be addressed immediately. Non-urgent concerns may be handled the next business day.
ARTICLE XII: LEGAL PROVISIONS
Section 12.1 Property Substitution
Elite reserves the right to substitute a comparable property from its managed portfolio if the original Property becomes unavailable due to ownership changes, removal from rental use, or extensive repairs needed. If comparable accommodations are unavailable within Elite's managed portfolio, you may select from other available Elite-managed properties or receive a complete refund. If the alternative property rate exceeds the original reservation rate, the guest is responsible for paying the difference.
Section 12.2 Chargeback Waiver
Renter agrees not to initiate a credit card chargeback without first attempting resolution with Elite Lake Rentals.
Section 12.3 Legal Fees
Renter agrees to pay all reasonable attorney's fees, legal costs, and collection costs incurred by Elite in enforcing this Agreement, recovering damages, pursuing unpaid balances, or defending claims arising from Renter's or Occupants' actions during the stay. This obligation applies whether enforcement occurs through negotiation, mediation, arbitration, litigation, or any other proceeding.
Section 12.4 Assignment
Elite may assign this Agreement or any of its rights, or delegate any duties, at any time without your consent.
ARTICLE XIII: DISPUTE RESOLUTION
Section 13.1 Choice of Law
This Agreement shall be governed by the laws of the State of Wisconsin, U.S.A., without regard to conflict-of-law provisions.
Section 13.2 Arbitration Agreement
Any controversy or claim arising out of or relating to this contract shall be settled by arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in the county where the Property is located, or in Wisconsin if the dispute does not involve a specific property.
Section 13.3 Exceptions to Arbitration
Both parties retain the right to pursue claims in small claims court within the court's jurisdiction, and suits to enjoin infringement or misuse of intellectual property rights.
Section 13.4 Class Action and Jury Trial Waiver
Any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. The parties waive any right to a jury trial.
ARTICLE XIV: LIMITATIONS AND DISCLAIMERS
Section 14.1 Acknowledgment of Risk
You acknowledge that the Property may have features and conditions unfamiliar to you, and that use of the Property and its amenities may carry inherent risks, including risk of bodily injury, illness, disability, or death. You voluntarily assume these risks and full responsibility for your choices. You acknowledge and agree that you and any other adult Occupants are solely responsible for closely supervising and protecting the health and safety of any minor children throughout the duration of your stay.
Wildlife and Natural Environment: Properties may be located in areas with natural wildlife including but not limited to bees, wasps, hornets, spiders, snakes, mice, bats, birds, deer, bears, or other animals. Neighboring pets may also wander onto the property and are beyond Elite's control. Bee nests, wasp nests, spider webs, and other wildlife habitats may appear seasonally and are beyond Elite's control. Guests assume all risks associated with wildlife encounters and neighboring animals and acknowledge that Elite cannot guarantee a wildlife-free environment or control neighboring pets. If wildlife or animals present an immediate safety threat, contact Elite immediately, but guests acknowledge that immediate removal may not always be possible due to environmental regulations, weather conditions, or specialist availability.
Section 14.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE AND OWNER EXPRESSLY DISCLAIM ANY WARRANTIES OF SAFETY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND AS TO THE ADEQUACY OF DIRECTIONS AND WARNINGS PROVIDED.
Section 14.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE, OWNER, AND THEIR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR DAMAGES FOR PERSONAL INJURY, ILLNESS, EMOTIONAL DISTRESS, OR PROPERTY DAMAGE ARISING FROM YOUR STAY.
Section 14.4 Indemnification
You agree to hold harmless and indemnify Elite, Owner, and their affiliates from all claims, demands, actions, losses, liabilities, damages, and expenses (including reasonable attorney's fees and legal costs) for property damage, personal injury, illness, or monetary loss resulting from your actions or the actions of other Occupants during your stay.
ARTICLE XV: CONSEQUENCES OF BREACH
Section 15.1 Breach and Termination
Any failure to comply with the terms of this Agreement constitutes a breach and may result in forfeiture of your rights to rent the Property, including immediate removal without refund, with or without law enforcement assistance. The following violations constitute material breach and grounds for immediate termination without refund: age misrepresentation or failure to meet minimum age requirements; exceeding maximum occupancy limits; violation of noise policies after warning; smoking or vaping violations; bringing unauthorized pets or animals; engaging in criminal activity including underage drinking, marijuana use, illegal drugs, or drug paraphernalia; tampering with safety devices; causing intentional damage to the Property; and septic system violations that cause backup or system failure.
Section 15.2 Immediate Removal
Elite may terminate this Agreement for breach, and upon notification of such termination, you agree to leave the Property immediately.
ARTICLE XVI: MISCELLANEOUS PROVISIONS
Section 16.1 Property-Specific Terms
Certain jurisdictions and specific properties may require additional terms and conditions. Any Property-Specific Terms will be communicated during the reservation process and will control over conflicting provisions in this Agreement.
Section 16.2 Third-Party Channel Terms
If booking through a third-party marketing channel, your booking may be subject to that channel's terms and conditions, which will control over conflicting provisions in this Agreement.
Section 16.3 Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements relating to the subject matter herein.
Section 16.4 Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Section 16.5 Survival
Sections 7.2 (Damage and Liability), 12.3 (Legal Fees), 13 (Dispute Resolution), 14 (Limitations and Disclaimers including Indemnification), and all other provisions that by their nature should survive, shall continue in full force and effect after the conclusion of your stay.
Section 16.6 Amendments
This Agreement may not be amended or modified except by a written document signed by both parties. No oral agreements, representations, or modifications shall be binding. Any proposed amendment that is not accepted in writing by Elite is void.
THIS PROPERTY IS MANAGED BY ELITE LAKE RENTALS LLC
A BREACH OF ANY OF THE ABOVE TERMS MAY RESULT IN A FORFEITURE OF YOUR RIGHTS REGARDING THIS RENTAL PROPERTY, INCLUDING EVICTION FROM THE PREMISES WITHOUT REFUND.
By booking with Elite Lake Rentals through any method (online, phone, or third party), you acknowledge that you have read, understood, and expressly agree to be bound by all terms and conditions set forth in this Agreement. These terms are available on the EliteLakeRentals.com website as well as all third-party booking channels prior to booking and must be accepted in order to process payment. Your booking confirmation serves as your electronic signature and acceptance of this Agreement, and you waive any claim that you did not receive or review these terms.
